Studio Marketplace Licenses
Did you know that when you purchase an item from the Studio Marketplace you’re actually purchasing a license to use that item? We have different types of licensing so its important to understand our licenses!
Rights
The seller of the Item retains ownership of the Item but grants you the license on these terms. All images, videos, graphics, digital assets, digital images, best practices and documentation remain the sole and exclusive property of the seller and protected by copyright and other laws that protect intellectual property and proprietary rights. This license is between the seller of the Item and you. Studio Marketplace is not a party to this license or the one giving you the license.
What’s in an item
Items sold on the Studio Marketplace may include image, videos, graphics, digital assets, digital images, best practices and documentation for the purpose of teaching, instructing, for you to deliver painting event or party. You can use the effects and techniques demonstrated in the item, and the knowledge you learn, for personal or commercial purposes, without needing to say where you learned it or to accredit the seller.
What’s included with all licenses
All of our licenses grants you, the buyer, a non-exclusive, non-transferable, revocable license to make use of the digital images only from the item you have selected in any form of marketing, digital or broadcast media, including in your own branding, for the sole purpose to promote the application of the item you have purchased. You can’t use an Item in a logo, trademark, or service mark, or include it in physical products for resale, such as T-Shirts or printed calendars as an example.
For example, you can use a high-res image of your item displayed your website calendar system or in mass email, added to a flyer to promote your event.
License types
We have three “Use” license types that grant you, the buyer, a non-exclusive, non-transferable, revocable license to teach, instruct and deliver a painting event or party using the item. The license types limit the number of times you can use the item.
Single-Use License: This grants you a single-use of the item
Extended-Use License: This grants you three (3) uses of the item
Unlimited-Use License: This grants you unlimited use of the item
Once and item has been used to its licensed limit it may no longer be used, including all use of the digital material used to market and promote that item. Additional licenses will need to be purchased if you would like to use the item again at another painting event or party, or to continue to list the digital material as part of your marketing and sales process.
For example, if you purchase an item with a Single-Use license you can use it to instruct and deliver a single paint night event at a studio or you can use it to instruct and deliver a single mobile party. Once the event and party has concluded you no longer have a valid license and also must remove the image of the item from any site or service that would be considered used for additional sales and marketing of that item.
With that same example if you purchase an item with an Extended-Use or Unlimited use license you may continue to deliver additional paint night events, private parties or mobile parties of that item, market and sell that item for future use until you have exhausted your use of the license.
Marketing-Only License: This allows you to use only the digital images included in the item for marketing, branding or promoting the item. A valid “Use” license is not included and one is needed for the item included in order to deliver and instruct a painting event or party with the item.
Additional Licensing Terms
This license applies in conjunction with the Studio Marketplace terms for your use of the Studio Marketplace. If there is an inconsistency between this license and the Studio Marketplace terms, this license will apply to the extent necessary to resolve the inconsistency.
This license can be terminated if you breach it. If that happens, you must stop using the item, including any digital marketing materials associated with the breached item.
Limitations
The manner and method of a buyers instructions, teaching and ultimately how they handle their own application of the item is solely at the discretion of buyer and the seller has no right to control buyers manner and method of performance under this Agreement.
